UNIT 11 CONTRACTUAL CONDITIONS
Unit summary
This unit is about ensuring that the candidate understands the principles of the conditions of contract. There are now a number of different forms of contract in use in the construction industry. Some are used entirely for building works and others for works of civil engineering construction. Whilst the different forms of contract cover many similar issues they can be significantly different in detail. Candidates should relate the following to a form of contract with which they are familiar.
Aims
This unit aims to enable candidates to understand the principles and practice of the main contractual clauses.
Students will require a current form of contract to use in conjunction with this unit. Examples of case law should be introduced and explained where appropriate.
The unit follows on from Unit 4 (Contract Documents) which provides a brief introduction to the conditions of contract.
Outcomes
On successful completion of the unit the candidate will be able to:
- understand the significance of the Articles of Agreement and Appendix
- use relevant clauses relating to the quality of work during construction
- use relevant clauses relating to the costs of construction
- use relevant clauses relating to the time factor of construction
- use relevant clauses relating to the works by other persons
- use relevant clauses relating to the injury and insurance of the works
- use relevant clauses relating to the subcontracting forms of contract
Assessment
The outcome of this unit will be assessed on the production of a word processed report of about 1500 words and a 2 hour open book examination or end of Unit test.
The report will show the candidate’s understanding of the seven areas of knowledge given in the unit content. The report should include elements of problem solving and refer to existing case law where this is appropriate.
- Data from the candidate’s organisation or work should be included to give example and to widen the scope of the report
Examples of good and poor practice should be included where relevant, together with any particular points which were found helpful.
The examination or end of unit test should be open book, and candidates will be allowed to use their own notes or textbooks to assist in this part of the assessment process.
