Unit 9:    Office based contract administration and practice for building and civil engineering - Level 3

 

Unit Summary

This unit concerns the knowledge and skills required to demonstrate an understanding of:

  • law and the formation of contracts for building and civil engineering work
  • standard forms of contract used in building and civil engineering work
  • types of contract
  • tendering procedures
  • functions, responsibilities and obligations of the parties to a contract
  • measurement, valuation and certification of work
  • settlement of dispute
  • office based administrative procedures.

This unit is divided into eleven outcomes which may be studied separately.  Alternatively, you may use occupational evidence for accreditation of each outcome, separately or collectively.

 

Aims

This unit aims to enable the candidate to:

  • acquire an understanding of all the stages involved in preparing contract documents and other documentation required in building and civil engineering
  • gain a working knowledge of essential documents used in different types of contracts
  • understand the different requirements of the law and legislation in relation to building and civil engineering works
  • understand the role of contractors and specialist contractors together with the mechanisms by which they are chosen and the conditions that may be applied to the work for which they are contracted.

 

Outcomes

On successful completion of the unit the candidate will be able to:

  • distinguish between civil, criminal and contract law
  • describe the essential elements of a contract and its terms and conditions
  • identify standard forms of contract used for building and civil engineering work and outline categories within each and the types of work where each would be used
  • describe the format of a bill of quantities contract and explain the components of the contract documents and their purpose
  • explain how main and subcontractors are selected through tendering procedures
  • explain the functions, responsibilities and obligations of the parties to a contract
  • explain procedures used for the measurement and valuation of work completed by main and subcontractors
  • explain how variations to the contract may be valued
  • describe the administrative procedures associated with certification and payment of contractors and subcontractors
  • describe procedures for the settlement of disputes
  • explain procedures and office based practice related to the administration of a contract.

Assessment

The outcomes of this unit will be assessed on the production a portfolio of work demonstrating an understanding of office based contract administration and practice for building and civil engineering.  The portfolio of work must include:

  • a report outlining the basics of contract law, including reference to:
  • different types of contract
  • tendering procedures
  • the functions, responsibilities and obligations of the parties to a contract
  • examples of measurement and valuation of building and civil engineering works carried out by the candidate together with explanations of the role of measurement and valuation within the context of the contract,
  • completion of certificates and other pro-forma together with descriptions of the need for and role of each type of document,
  • a report detailing ways in which variations are measured and disputes settled,
  • information relating to office based contract administration systems.

The portfolio must contain text, pro-formas, charts, abstracts from contract documents and supplied information.
